A patron is allegedly overserved at the lodge, leaves, and causes a crash that injures another person.1

Injury arising from alleged intoxication

The form may respond to covered Loss and Defense Costs from a third-party bodily injury claim alleging that selling, serving, or furnishing alcohol caused or contributed to a person’s intoxication. Coverage depends on the facts and the complete issued policy.

Service to a person under the influence

The form may respond to covered bodily injury or property damage claims alleging service to a person under the influence, including liability imposed by an applicable dram-shop or liquor-control law.

A claim alleges that a person under legal drinking age was served alcohol at the declared premises.3

Underage-service allegations

The form can apply to an allegation of underage service, but it excludes knowing service to someone under legal drinking age for the insured who knew. The policy’s separation-of-insureds and knowledge provisions matter to the analysis.

Policy notes

The base form applies only to the operations and premises described in the Declarations. It does not include off-premises liquor events, catering, or mobile bartending unless a written endorsement changes that boundary. Delivery applies only when expressly shown.

Cannabis and THC beverages, professional services, employment practices, weapons, expected or intended injury, punitive damages, and other exposures are excluded or restricted. The required liquor license must remain in effect.

Liquor Liability, Commercial General Liability, and off-premises event coverage address different operations and claim triggers.

Liquor Liability

What triggers it: A covered occurrence involving bodily injury or property damage arising from selling, serving, or furnishing alcohol. Common scenario: A patron is allegedly overserved and later injures a third party. Key difference: It addresses the alcohol-service exposure that a standard general liability policy may exclude for a business in the alcohol trade.

Commercial General Liability

What triggers it: Covered premises or operations claims involving bodily injury, property damage, or certain personal and advertising injury. Common scenario: A visitor slips at the lodge. Key difference: CGL addresses general premises and operations exposure; it should not be assumed to replace standalone liquor liability.

Off-premises liquor events

What triggers it: Alcohol service away from the declared premises, including catering or mobile bartending. Common scenario: A lodge serves alcohol at a separate event venue. Key difference: The base form does not include this exposure unless an issued written endorsement or separate placement provides it.

Program Applicability & Compliance

Coverage Trigger

The form may respond to covered third-party bodily injury or property damage arising from selling, serving, or furnishing alcohol at the described operations and premises.

Policy Boundaries

The base form is occurrence-based, limits coverage to the described premises and operations, places Defense Costs inside the limits, and requires the liquor license to remain in effect. Exclusions and state endorsements apply.

Surplus Lines Placement

Coverage may be placed on a non-admitted surplus lines basis and is not protected by a state insurance guaranty fund. Required notices, taxes, fees, and availability vary by jurisdiction.

Available Endorsements

Additional Insured Endorsement

May add a qualifying liquor license holder, building owner or lessor, franchisor, or other scheduled person or organization. Status is limited by the issued endorsement, does not create broader coverage than stated, and does not increase policy limits. [Endorsement required]

Aggregate Limit Modification

May provide a double or triple policy aggregate or apply the aggregate separately by scheduled location when offered and issued. The per-occurrence limit does not automatically change. [Endorsement required]

Waiver of Transfer of Rights of Recovery

May waive recovery rights for a scheduled person or organization when required by a written contract executed before the occurrence. It applies only when the endorsement is issued in writing. [Endorsement required]

Occurrence
An accident, including continuous or repeated exposure to substantially the same harmful conditions, resulting in covered bodily injury or property damage during the policy period.
Common Cause
Related acts or omissions treated as one cause when the assault-and-battery sublimit is applied, as defined by the issued form.
Selling, Serving or Furnishing
Includes providing, giving, distributing, delivering, or pouring alcohol, and permitting alcohol brought onto the insured premises for consumption.
Declared Premises
The location specifically described in the Declarations. The base program does not automatically follow operations to other locations or off-premises events.
Sublimit
A lower limit applying to a specific exposure, such as assault and battery. It is part of, not in addition to, the policy’s applicable limits.
Defense Costs
Legal and related claim-defense expenses. Under this form they are included within, and reduce, the applicable limits and may exhaust them.
Policy Aggregate
The most the insurer will pay for covered Loss and Defense Costs across the policy period, unless an issued endorsement changes how the aggregate applies.
Per-Occurrence Limit
The most the insurer will pay for covered Loss and Defense Costs arising from one occurrence, subject to all other policy terms.
Gross Alcohol Receipts
Receipts from alcohol sales used as a rating and premium-audit basis under the program materials.
Retention
The amount shown in the Declarations that the insured is responsible for under the policy before the insurer’s payment obligation applies.

The issued policy controls every coverage determination.
The current program materials are designed for eligible veterans’ and fraternal lodges operating licensed on-premises bars. Eligibility is determined through underwriting and may vary by state and risk characteristics.
